Brianna Aguliera, a 19-year-old Texas A&M student died after tumbling over an apartment balcony on Nov. 29.
On Nov. 28 during the Austin Rugby Club’s tailgate, police say Aguilera wandered into a wooded area while intoxicated where she lost her phone and several of her belongings. Several witnesses claim Aguilera was asked to leave the tailgate numerous times.
Phone records revealed Aguilera used a friend’s phone to call her boyfriend around 12:43 a.m. from the 21 Rio Apartments in Austin’s West Campus neighborhood.
Witnesses heard Aguilera argue with her boyfriend over the phone, Austin Police Department (APD) Lead Detective Robert Marshall said. Aguilera’s boyfriend confirmed to police that the conversation had turned into an argument.
Two minutes later, police received a 9-1-1 call about a woman found unresponsive on the sidewalk below the 21 Rio Apartments. According to a police affidavit, Aguilera suffered injuries consistent with a 17-story fall and was declared dead later that morning.
On Dec. 1, the APD confirmed their officers responded to the 9-1-1 call.
Aguilera’s phone was found in do-not-disturb mode by a creek near the apartment building, in the same wooded area Aguilera lost it on Friday.
During the initial investigation, authorities labeled Aguilera’s death a suicide following the discovery of suicidal notes and messages in her phone.
But Aguilera’s mother, Stephanie Rodriguez, said her daughter did not exhibit any signs of suicidal behavior or thoughts. Rodriguez also said Aguilera always shared her location with her.
Aguilera’s family has shared concerns on social media about possible foul play.
Houston attorney Tony Buzbee, who along with the Gamez Law Firm, represents Aguilera’s family, criticized the APD’s investigation. Buzbee claims the APD failed to properly notify Aguilera’s family throughout the investigation.
The attorneys also claim APD superseded the Travis County Medical Examiner’s authority by determining Aguilera’s death as a suicide. Aguliera’s autopsy, toxicology report, and sexual assault kit results have not yet been released.
Buzbee called on APD Police Chief Lisa Davis to remove Robert Marshall from any reinvestigation.
Aguilera’s family is now urging Gov. Greg Abbott and the Texas Rangers to take over the investigation.
